USER AGREEMENT

This Agreement helps keep Jedediah STARR Trading Co. a safe and legal place to buy Muzzleloading Blackpowder Replica Firearms, Center Fire Blackpowder Cartridge Firearms, Ammunition and Accessories. Jedediah STARR Trading Co. is built on trust, and this Agreement helps promote that trust among all members of the gun owning community.

THE FOLLOWING DESCRIBES THE TERMS ON WHICH Jedediah STARR Trading Co. OFFERS YOU ACCESS TO OUR SERVICES. BY SUBMITTING AN ORDER TO US, YOU CERTIFY TO AND ACCEPT THE TERMS AND CONDITIONS BELOW.

This Agreement describes the terms and conditions applicable to your purchase of Blackpowder Replica Firearms and Center Fire Blackpowder Cartridge Guns from Jedediah STARR Trading Co a division of Bloomfield American Corp. By submitting an order to us, you accept the terms and conditions of this Agreement. If you do not accept these terms and conditions or have any questions, please contact us Toll Free at 1-877-857-8277 or at WWW.Jedediah-Starr.com.

We may amend this Agreement at any time.

The amended terms shall automatically be effective 30 days after they are initially posted on our web site. This Agreement may not be otherwise amended except in a writing signed by both parties.

Eligibility to Purchase. Our services are available only to individuals who can form legally binding contracts under applicable law. Without limiting the foregoing, we can only sell Muzzleloading Blackpowder Replica Firearms and Center Fire Blackpowder Cartridge guns to persons 21 years of age or older.  All purchasers of Muzzleloading and Center Fire Firearms must comply with all Federal, State and Local laws. If you do not qualify, please do not place and order. 
 

ATTENTION: Residents of HI, IL, MA, MI, NJ, and NY please check your local laws for restrictions before ordering any Muzzleloading Firearms or Ammunition.

We Cannot Ship Black-Powder Firearms to individuals in the following categories:

• P.O. Boxes when shipping to the United States (a physical address is required)
• APO/FPO addresses
• United States addresses that have a zip code that starts with 606
• United States addresses that have a zip code that starts with 607
• United States addresses that have a zip code that starts with 608
• United States Territories
• New Jersey

We Cannot Ship Pyrodex and other Blackpowder Substitutes to individuals in the following categories:

• APO/FPO addresses
• P.O. Box when shipping to the United States (a physical address is required)

  • Purchase of a Muzzleloading Gun:
  • Muzzleloading Guns do not require Federal Licensing or registration, however Local and State laws may require it. Purchasers must be 21 years and certify that there is no State or Local laws prohibiting them from purchasing Muzzleloading Guns, Primers, Powder, or Knives
     
  • Purchase of Center Fire Blackpowder Cartridge guns:

  • You as the purchaser are responsible for arranging for a Federal Firearms Dealer in your local area, to receive the firearms from us and transfer them to you. We will supply a list of FFL Dealers in your state or you may choose any other FFL dealer you wish to deal with.  We supply the FFL Dealer list only as a convenience to our customers. We do not guarantee its accuracy or the ability of any dealer on the list to perform the firearm transfer. Supplying you with the FFL Dealer list should not be considered a endorsement  or recommendation by us to use any dealer on the list.

  • In addition you are responsible for obtaining any applicable permits, paying all applicable taxes and any transfer or service fee that the delivering FFL dealer may require. Jedediah STARR Trading Co. will send to you a Gift Certificate for $30.00 for each Center Fire Blackpowder Firearm you purchase from us, to help offset the Transfer or Service Fee.   This gift certificate is valid for orders of $100.00 or more and only one certificate per order may be used.
  • We are an FFL Dealer Transferring the firearm to the Delivering FFL Dealer who will transfer it to the Purchaser.  Jedediah STARR Trading Co. has no involvement in the actual transaction between Buyers and Delivering FFL Dealer.  As a result, we have no control over the ability of the Delivering FFL Dealer to deliver the Firearm or the ability of buyers to buy items. We cannot and do not control whether or not the Delivering FFL Dealer will complete the Transfer of the items they receive from us or that  buyers will be able to complete the Transfer of items they have purchased from Jedediah STARR Trading Co..  If you, as the buyer are unable to complete the transaction, because you do not comply with Federal, State or Local laws, the firearm must be returned to us PREPAID and  we will refund your purchase price less any damage.  In any event you may be required to pay the Delivering FFL Dealer Transfer or Service Fee.  We also encourage you to communicate directly with the FFL Dealer  to help you evaluate with whom you are dealing. Please practice safe trading.
  • In the event that you have a dispute with Your Delivering FFL Dealer, you release Jedediah STARR Trading Co., a division of Bloomfield American Corp., (and our agents and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. If you are a California resident, you waive California Civil Code §1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor." We expect that you will use caution -- and common sense -- when selecting a Delivering FFL Dealer to handle your order. 

2.  No Warranty. WE AND OUR SUPPLIERS PROVIDE OUR PRODUCTS AND OUR SERVICES "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS OR IMPLIED. WE AND OUR SUPPLIERS SPECIFICALLY DISCLAIM THE IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Some states do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you. This warranty gives you specific legal rights and you may also have other legal rights which vary from state to state.

3.  Limit of Liability.  IN NO EVENT SHALL WE OR OUR SUPPLIERS BE LIABLE FOR LOST PROFITS OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES (HOWEVER ARISING, INCLUDING NEGLIGENCE) ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT.

4.  General Compliance with Laws. As the Buyer, you shall comply with all applicable Federal, State, and Local laws, statutes, ordinances and regulations regarding your purchase of Firearms, Ammunition and Accessories.

5.  General. This Agreement shall be governed in all respects by the laws of the State of Michigan as such laws are applied to agreements entered into and to be performed entirely within Michigan between Michigan residents. Both parties submit to jurisdiction in Michigan and further agree that any cause of action arising under this Agreement shall be brought exclusively in a court in Detroit, Michigan . If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. This Agreement sets forth the entire understanding and agreement between us with respect to the subject matter hereof.

6.  Disclosures. The services hereunder are offered by Jedediah STARR Trading Co., a division of Bloomfield American Corp., located at 25275 Regency Dr., Novi, MI 48375.

7.   Federal Rules about Firearms Transactions. As a Mail-Order supplier of Muzzleloading and Blackpowder Cartridge firearms to hunters, shooters, re-enactors, collectors, traders, and owners, Jedediah STARR Trading Co. has no ability to verify the age, mental state, or legality of buyers. The U.S. Government requires that buyers comply with the legal age restrictions regarding the sale of firearms and ammunition and that all interstate sales of regulated firearms be done through registered Federal Firearms Licensed Dealers (FFL dealers). Further, once shipment has proceeded between Jedediah STARR Trading Co. and the Delivering FFL Dealer, the buyer and the Delivering FFL Dealer must comply with any and all Federal, state, or local laws concerning firearms sales.  

8.   International Purchase Transactions. As a Mail-Order supplier of Muzzleloading and Blackpowder Cartridge firearms to hunters, shooters, re-enactors, collectors, traders, and owners, Jedediah STARR Trading Co. has no ability to verify that buyers comply with the legal  restrictions regarding the sale and purchase of firearms and related items in foreign countries.  As the Buyer, you shall comply with all applicable Federal, State, and Local laws, statutes, ordinances and regulations regarding your purchase of Firearms, Ammunition and Accessories.   All sales outside the United States are final and the products cannot be returned.  Warranty claims should be made directly with the manufacturer of the product.  If the buyer is not in compliance with local laws in the country of import the products may not be returned to the United States and are usually destroyed by the local government officials.
